Easements FAQs

You should contact your lawyer to answer questions about easements on your property.

A title search and/or legal survey for your property will provide you with information about which entity an easement was established in favour of, for example, a utility company, an adjacent property owner, the City, the Region of Peel, the Province, etc. Questions about specific easements should be directed to the individual easement owners.

Easements are noted on legal surveys and are described in more detail in a title search for a property. Legal surveys and title searches are referenced during the sale and purchase of a property.

Easements are established on properties to allow for buried pipes or wires, overhead wires or shared access driveways, etc. Easements are generally registered on the title of the land and are transferred with the land when the ownership changes.

Easements can only be removed if the original purpose for establishing the easement no longer exists. Questions about removing an easement should be directed to the easement owner.
